Republican presidential hopeful Donald Trump has pledged his support to gun lovers. And just to drive the point home, he has also been announcing on the campaign trail that if Hillary Clinton wins the White House, she will abolish the 2nd amendment. Trump is either ignorant on how the US Constitution works, or just lying to low information voters who also don’t know how the US Constitution works.
In fact, no president has the power to repeal any part of the constitution unilaterally. Furthermore, Hillary Clinton never said she wanted to abolish the 2nd amendment.
In order to repeal the 2nd amendment, or any other amendment, congress would have to submit a proposal to repeal the 2nd amendment. Then, two-thirds of the House and Senate would have to approve the proposal. After that, it would have to be ratified by three-fourths of the states.
The Congress, whenever two thirds of both houses shall deem it necessary, shall propose amendments to this Constitution, or, on the application of the legislatures of two thirds of the several states, shall call a convention for proposing amendments, which, in either case, shall be valid to all intents and purposes, as part of this Constitution, when ratified by the legislatures of three fourths of the several states, or by conventions in three fourths thereof, as the one or the other mode of ratification may be proposed by the Congress; provided that no amendment which may be made prior to the year one thousand eight hundred and eight shall in any manner affect the first and fourth clauses in the ninth section of the first article; and that no state, without its consent, shall be deprived of its equal suffrage in the Senate.
Yes, our founding fathers loved fractions. They also didn’t want the constitution messed with, which is why they made it so hard to amend.
Despite all that, there have been 27 amendments. One that Americans are sure to be familiar with is the repeal of prohibition.
From the Constitution Center:
The nation’s fourteen-year experiment with prohibition ended on December 5, 1933, when Utah became the thirty-sixth state to ratify Amendment XXI. Amendment XXI returned the regulation of alcohol to the states. Each state sets its own rules for the sale and importation of alcohol, including the drinking age.
As far as Donald Trump is concerned, he either needs to get a basic understanding of the US Constitution, or stop lying about how easy it is to abolish the 2nd amendment.
